Investor Residence Card
The Investor Residence Card (Carte de Résident pour Investisseurs Économiques) is the Republic of the Congo's immigration pathway for foreign nationals making qualifying investments in the country. Under the Immigration Law (Law No. 23-96 of 6 June 1996, as amended by Law No. 29-2017), the residence card is issued automatically ("de plein droit") to economic investors, bypassing the standard documentation requirements that apply to other applicants. The program is administered by the Direction Départementale de la Surveillance du Territoire under the Ministry of the Interior, Decentralisation and Local Development. Eligibility is based on investment projects approved under the Investment Charter (Law No. 6-2003), with implementing procedures set out in Decree No. 2004-30. The Investment Charter guarantees that any person, regardless of nationality, may undertake agricultural, mining, industrial, forestry, artisanal, commercial, or service activities on Congolese territory. The Agence pour la Promotion des Investissements (API-Congo), created in 2013, facilitates investment registration and approval. The Republic of the Congo is a member of CEMAC and OHADA, which provide a harmonised business law framework across member states.
The Investment Charter defines two privileged investment regimes:
- Regime General (G): Minimum investment of 100 million FCFA (~EUR 152,450 / ~USD 160,000)
- Regime Special (S): Investment of 30–99 million FCFA (~EUR 45,735–150,925 / ~USD 48,000–160,000)
Enterprises must have equity capital equal to or greater than one-fifth of the total investment. Direct foreign investment from outside the franc zone exceeding 100 million FCFA requires a prior declaration to the Ministry of Finance and the Central Bank at least 30 days before the transfer of funds, with a 20% penalty for non-compliance. The Investment Charter also requires enterprises to prioritise local raw materials and local business services under equal conditions of price, quality, and delivery time, and to prioritise local labour at equal competence levels.
Common business structures available to foreign investors include SARL (Société à Responsabilité Limitée, minimum capital 1 million FCFA / ~EUR 1,525), SA (Société Anonyme, minimum capital 10 million FCFA / ~EUR 15,245), and sole proprietorship. Single-shareholder companies are permitted, and foreign nationals may serve as directors and reside abroad. Foreign investors do not need a Congolese partner to establish a business.
- Investment project approved by the Commission Nationale des Investissements (CNI) under one of the privileged investment regimes

Residence visa fees vary by duration: 1-year visa costs 106,000 FCFA (~EUR 162), 3-year visa costs 206,000 FCFA (~EUR 314), and 5-year visa costs 106,000 FCFA (~EUR 162). Express processing ("Visa Express") is available for same-day issuance at additional cost. Work permits for foreign employees cost 10,000 FCFA.
The ordinary residence card is valid for 1 year and is renewable. After 10 years of uninterrupted residence in the Republic of Congo, holders may apply for the privileged residence card valid for 5 years with automatic renewal. Renewal must be submitted within the month preceding expiration -- failure to renew triggers deportation procedures. For the privileged card, applicants must be under 35 years old at the time of first entry to Congolese territory. This age limit is increased by 3 years per minor child, or by 5 years if married to a Congolese national or parent of a legally recognised Congolese child. Renewal fees are fixed by regulatory text.
The Investment Charter provides significant tax benefits. Regime General offers full corporate income tax and personal income tax exemption for 3 years, plus 50% reduction on registration duties and accelerated depreciation. Regime Special provides similar benefits with amounts set by ministerial decree. Additional incentives include an export incentive (zero TVA on exported goods), a reinvestment reduction (50% corporate/personal income tax reduction for 3 years on reinvested profits), and enclave zone development incentives. Standard corporate income tax is 33% on company profits. Dividend withholding is 15% (reduced from the standard 20%) when the parent holds 10% or more of the subsidiary. Royalty withholding is also 15% (reduced from the standard 20%).
Investors may operate their approved investment enterprise across most sectors. Excluded activities under the Investment Charter include arms manufacturing and importation, toxic waste treatment and importation, and pure commercial trading (excluding local product distribution and export). The petroleum sector requires joint ventures with the Société Nationale des Pétroles du Congo (SNPC). Country managers of businesses must either be Congolese nationals or foreign nationals who have been resident for 2 or more years.
Foreign nationals initially enter the Republic of Congo on a business or visitor's visa (maximum 3 months), obtained from a Congolese embassy or consulate abroad. Required entry documents include a valid passport with at least 6 months validity, completed application form, two identity photographs, letter of invitation, return transport documentation, and international vaccination certificate. Citizens of Benin, Burkina Faso, Cameroon, Central African Republic, Côte d'Ivoire, Guinea Conakry, Morocco, Mauritania, Niger, Senegal, Chad, and Togo are exempt from visa requirements. Once in Congo, foreigners must negotiate a residence visa with the Direction Départementale de la Surveillance du Territoire, and documentation must be submitted within 8 days of entry.
Foreign investors first obtain approval for their investment project from the CNI, which examines applications under Decree No. 2004-30. Business registration is completed through the Agence Congolaise pour la Création des Entreprises (ACCE) within a maximum of 48 hours. Registration documents issued include the Registre du Commerce et du Crédit Mobilier (RCCM), company registration numbers, and a unique identification number (NIU). Once the investment is approved and the business is registered, the investor applies for the residence card, which is issued automatically for economic investors. Standard visa processing does not exceed 15 days, with express same-day processing available at additional cost.
The Republic of the Congo does not have a dedicated "golden visa" or formal residence-by-investment programme offering passive investment routes such as real estate purchase or government bond investment. The investor residence card is part of the general immigration framework, with automatic issuance as the key benefit for qualifying economic investors. This program requires active business investment approved under the Investment Charter, not passive capital placement. Specific provisions for dependants of economic investors are not detailed in official sources -- general immigration law provisions under Law 23-96 and Law 29-2017 govern family members of residents. Failure to renew the residence card within the month preceding its expiration triggers deportation procedures. Residents who harbour foreigners who have entered irregularly must report to authorities within 48 hours.
