Argentina's Residencia Temporaria Pensionado (Temporary Residency for Pensioners) is a residency pathway under Article 23(c) of the Migration Law (Ley No. 25.871) for foreign nationals who receive a pension from a foreign government, international organisation, or private company for services rendered abroad. The pension must meet a minimum monthly threshold tied to Argentina's minimum wage, making this an accessible option for retirees with documented foreign pension benefits. The permit allows holders to live in Argentina with multiple entries and exits and provides a path to permanent residency.

Requirements

Duration & Renewal

The initial permit is valid for up to 3 years with multiple entries and exits. Renewals are granted in 1-year extensions. Apply for renewal within 60 days before expiry through the RaDEX platform with updated pension documentation. Late renewal within 30 days after expiry incurs a 50% surcharge on fees. Absence from Argentina for 6 or more continuous months results in cancellation of residency status.

Family Members

Argentina guarantees the right to family reunification under Article 10 of Ley 25.871, covering spouses, children, and parents. Family members may apply for their own temporary residency. The primary applicant must demonstrate that their pension income is sufficient to support themselves and their family group. Minor children under 18 applying jointly with a parent are exempt from the migration processing fee.

Tax Implications

Temporary residents who reside in Argentina with the intention of habitual residence are considered tax residents, subject to income tax (Impuesto a las Ganancias) on worldwide income. Tax residency is triggered after 12 months of presence (with temporary absences not exceeding 90 days) or upon demonstrating intent of habitual residence. Tax residents may also be subject to the personal assets tax (Impuesto sobre los Bienes Personales) and must file annual returns with ARCA (formerly AFIP).

Application Process

From outside Argentina: Begin by requesting a Permiso de Ingreso (entry permit) via email to tramitacion.ingresos@migraciones.gob.ar or in person at the DNM Central Office. Include a written request with personal details, a copy of the pension-granting document, and three recent pay stubs. Once approved, present the permit at the corresponding Argentine consulate to obtain a visa for entry.

From within Argentina: Apply through the RaDEX platform (migraciones.gob.ar/radex) — register, complete the application form, pay fees, upload documents, and attend a mandatory in-person appointment at DNM offices. The applicant must be physically present in Argentina.

Upon approval, holders receive a Documento Nacional de Identidad (DNI) for foreigners and a CUIL (tax identification number).

Path to Permanent Residency

Non-MERCOSUR nationals may apply for permanent residency after 3 years of continuous temporary residency. MERCOSUR nationals may apply after 2 years. Applicants must demonstrate physical presence in Argentina exceeding 50% of their authorised residency period.
