Nómada Digital
Peru's Nómada Digital (Digital Nomad) residence migration status was established by Decreto Legislativo No. 1582, published on 14 November 2023. This decree modified Peru's Migration Law (Decreto Legislativo No. 1350) by creating a new resident migration category for foreign nationals who work remotely for employers based outside Peru. The program is administered by the Superintendencia Nacional de Migraciones (MIGRACIONES), Peru's national migration authority. However, as of February 2026, the program is not yet operational — the implementing regulations have not been published, meaning the visa cannot currently be applied for.
Although the legal framework exists, the digital nomad visa remains unavailable in practice. MIGRACIONES has stated that the status will begin to be granted once the resolution regulating the changes is published and the corresponding procedure is established in the entity's administrative procedures manual (TUPA). Two TUPA updates have occurred since the law's enactment (August 2024 and September 2025), and neither included the digital nomad category. No official timeline for implementation has been announced.

The law targets foreign nationals with a subordinate employment relationship with a company domiciled outside Peruvian territory. This definition may potentially exclude independent freelancers, consultants, and self-employed professionals who do not have a formal employment contract.
Under Peruvian tax law, individuals physically present in Peru for more than 183 days within a 12-month period become fiscally domiciled and subject to tax on worldwide income starting 1 January of the following year. There is a noted tension between the migration law (which characterises digital nomad income as non-Peruvian-source) and tax law (which may treat income from work physically performed in Peru as Peruvian-source income).
Foreign nationals who wish to work remotely from Peru currently use tourist status, which allows citizens of many countries (including the US, UK, and EU member states) to stay for up to 183 days per year without a visa. However, tourist status does not formally authorise remote work. The nómada digital status, once operational, would provide a legal framework specifically designed for remote workers with a longer permitted stay.
