Definitive Residency for Investors
El Salvador's Definitive Residency for Investors (Residencia Definitiva para Inversionistas) is a permanent residency pathway for foreign nationals who invest in or donate to government-promoted programmes. Established by a 2025 reform to the Ley Especial de Migracion y Extranjeria (adding Numeral 13 to Article 152), the programme allows eligible investors to obtain permanent residency directly, bypassing the usual requirement of first holding temporary residency. It is administered by the Direccion General de Migracion y Extranjeria (DGME) and entered into force on 13 May 2025. A key benefit is that holders are exempt from standard absence restrictions -- investor residents enjoy unlimited time outside the country without losing their residency status.

- All foreign documents must be apostilled or authenticated and translated into Spanish
The programme grants permanent (definitive) residency. The residency card is issued for 1 year initially and must be renewed for periods of up to 4 years. Renewal must be requested within 30 calendar days before expiration. The residency status itself is indefinite.
Immediate family members (spouse and dependent children) of the primary investor or donor may be included in the application. The reform legislation specifies that benefits extend only to direct family members, explicitly excluding third-party associates. Dependants are expected to submit their own identity documents and criminal record clearances.
El Salvador operates a territorial tax system. Under Decreto Legislativo No. 969 (March 2024), all foreign-sourced income is fully exempt from Salvadoran income tax. Residents who establish tax residency are subject to income tax on domestically sourced income and 13% VAT (IVA) on local consumption. Capital gains on cryptocurrency are also tax-exempt.
The specific application procedure is being developed by the DGME. Based on the reform legislation and general DGME procedures, the process involves:
- Identify and participate in a government-promoted programme through investment or donation
- Obtain proof of participation in the programme
- Gather required documentation including passport, apostilled criminal record clearance, and programme participation proof
- Submit a formal petition to the DGME in San Salvador
- Undergo documentation review and assessment
- Pay the USD 690 service fee
- Receive the definitive residency card upon approval
Unlike standard definitive residents, investors under Article 152, Numeral 13 are explicitly exempt from Article 154 of the migration law, which normally limits permanent residents to a maximum two-year absence. Investor residents have unlimited time to stay outside El Salvador without losing their residency status.
