Permanent Residence for Rentistas or Pensioners
Guatemala's Permanent Residence for Rentistas or Pensioners (Residencia Permanente para Rentistas o Pensionados) allows foreign nationals with stable passive income from abroad to obtain immediate permanent residency. Established under Article 78(e) of the Codigo de Migracion (Decreto Numero 44-2016), with implementing regulations under the Reglamento de Residencias Guatemaltecas (most recently updated by Acuerdo IGM-016-2025, effective October 2025), the program is administered by the Instituto Guatemalteco de Migracion (IGM). Unlike most countries that require progression from temporary to permanent status, Guatemala grants permanent residency directly, making it one of the most straightforward passive income residence pathways in the Americas.
- Minimum monthly income of USD 1,250 from passive sources outside Guatemala (investments, bank deposits, real estate, securities, pensions, retirement benefits, social security, disability, or widowhood payments)
- Additional USD 300 per month for each dependant
- Income must be permanent, lawful, and verifiable
- No specific educational, professional, or age qualifications required
- Criminal and police record certificate from country of origin or country of legal residence for the preceding 2 years, issued within the last 6 months
- Holders may not engage in any remunerated activity in Guatemala
- Completed residency application form
- Valid original passport with notarized complete copy
- Criminal and police record certificate (issued within 6 months, covering last 2 years of residence)
- Certified documentation proving monthly income of at least USD 1,250 (plus USD 300 per dependant)
- If income is in a non-USD currency, a conversion certification document must be included
- All foreign documents must be apostilled or legalized and translated into Spanish
- Application file presented in a green folder (rentistas) or purple folder (pensionados)
The program grants immediate permanent residence with no expiry date. Holders must update their data annually, pay the annual foreigners' fee (USD 40), and renew their immigration status certificate. Every 5 years, holders must present proof of continued income receipt certified by their country's embassy, along with a sworn declaration of survival and clean criminal records from Guatemala. After 5 years of permanent residency, holders may apply for Guatemalan citizenship through naturalization, which requires a civic and Spanish language examination. Guatemala permits dual citizenship.
Spouse, unmarried children, and children under 18 (or those declared in a state of interdiction) may be included as dependants, each requiring proof of additional USD 300 per month income. Under the 2025 regulations, dependant applications may be processed simultaneously with the principal applicant. Dependants who obtained permanent residence through the principal applicant do not lose their status upon the death of the principal.
Guatemala operates a territorial tax system under the Ley de Actualizacion Tributaria (Decreto 10-2012). Only Guatemalan-source income is subject to income tax. Passive income received from foreign sources (pensions, investment returns, rental income from abroad) is not taxable in Guatemala.
Applications are submitted in person at the Subdireccion de Extranjeria, IGM headquarters, located at 6 Avenida 3-11, Zona 4, Guatemala City. No Guatemalan guarantor is required for this category, which is a significant advantage over other residency categories. Processing takes approximately 6 to 8 months. Under the 2025 regulations, mandatory field verifications are conducted for all applications.
Fees:
- Application fee: USD 400 (pensionado category) or USD 700 (general permanent residence / rentista)
- Annual foreigners' fee: USD 40
Foreign nationals may enter Guatemala on a tourist visa (most nationalities receive 90 days visa-free under the CA-4 agreement with El Salvador, Honduras, and Nicaragua) and apply for permanent residency from within the country. Upon approval, the holder receives a cedula de extranjero (foreign resident identification card).
Permanent residents may travel freely in and out of Guatemala. For naturalization eligibility, applicants must not have been absent for more than 6 consecutive months or cumulative periods totalling one year or more during the 5 years preceding the application.
