EB-2 National Interest Waiver
- Advanced degree (U.S. master's, doctorate, or professional degree, or foreign equivalent) — OR a U.S. bachelor's plus 5 years of progressive post-baccalaureate experience in the specialty

- Dhanasar Prong 2: the applicant is well positioned to advance the endeavor based on education, skills, track record, plans, and supporting evidence
- Dhanasar Prong 3: on balance, it would benefit the United States to waive the job offer and labor certification requirements
- Discretionary analysis: positive and negative factors are weighed, including conduct, character, family ties, immigration history, country-specific facts, and any anti-American or antisemitic activity
The EB-2 National Interest Waiver (NIW) is a second-preference employment-based immigrant visa (green card) that allows individuals with advanced degrees or exceptional ability in the sciences, arts, or business to obtain permanent U.S. residency without employer sponsorship, a job offer, or labor certification. Alongside the EB-1A Extraordinary Ability category, it is one of only two employment-based immigrant pathways permitting self-petition. The analytical framework was established by the precedent decision Matter of Dhanasar (AAO 2016) and substantially clarified by USCIS policy guidance issued in January 2025, with further updates in August and November 2025 emphasizing a separate discretionary analysis unique to NIW petitions.
Applicants must satisfy two layers of eligibility:
EB-2 threshold eligibility — one of the following:
- Advanced degree: a U.S. master's, doctoral, or professional degree (or foreign equivalent); OR a U.S. bachelor's plus at least 5 years of progressive post-baccalaureate work experience in the specialty
- Exceptional ability: a degree of expertise significantly above that ordinarily encountered, demonstrated by at least 3 of 6 criteria — academic credentials, 10+ years of documented full-time experience, professional license or certification, high salary relative to peers, professional association membership, or recognition for contributions by peers or governmental entities. For NIW seekers relying on exceptional ability, that ability must relate to the proposed endeavor.
Three-prong Dhanasar national interest waiver test:
- The proposed endeavor has substantial merit and national importance — it must go beyond a single employer and have broader implications for a field, region, or the general public. Generic occupational importance is insufficient.
- The petitioner is well positioned to advance the endeavor — based on education, skills, knowledge, track record, plans, and supporting evidence (publications, patents, letters from investors or government agencies).
- On balance, it would benefit the United States to waive the job offer and labor certification requirements.
Discretionary analysis (separate step): After threshold and three-prong eligibility are established, USCIS conducts a discretionary analysis — a step unique to NIW (and certain EB-5 petitions) among employment-based categories. Officers weigh positive and negative factors including conduct, character, family ties, immigration history, humanitarian concerns, country-specific facts, and the impact of INA § 212(f) and Presidential Proclamation 10949. Endorsement, promotion, or support of anti-American or antisemitic terrorist organizations or ideologies is treated as an overwhelmingly negative factor. USCIS now performs expanded social media vetting as part of this review.
No minimum income, salary, or financial proof is required for the I-140 petition itself.

EB-2 NIW grants unconditional lawful permanent residence. The physical green card is valid for 10 years and renewed via Form I-90 (fee $540) as a routine administrative step. Permanent residents may apply for U.S. citizenship (naturalization) after 5 years of continuous permanent residence, or 3 years if married to a U.S. citizen.
Once the green card is issued, holders may travel freely but must maintain the United States as their primary residence. Absences exceeding 6 months may raise abandonment questions; absences exceeding 1 year generally create a presumption of abandonment. A re-entry permit (Form I-131) may be obtained for planned absences of up to 2 years.
Spouse and unmarried children under 21 may be included as derivative beneficiaries — classified as E-21 (spouse) and E-22 (child). They apply for adjustment of status (Form I-485) or consular processing (Form DS-260) concurrently with the principal applicant and undergo their own background checks and medical examinations. Spouses of pending I-485 applicants may file Form I-765 for an Employment Authorization Document while adjustment is pending.
Permanent residents are U.S. tax residents subject to worldwide income taxation. Annual federal income tax returns (Form 1040) must be filed with the IRS reporting all worldwide income. Foreign tax credits may be claimed for taxes paid to other countries. State income tax obligations vary by state of residence.
The process has two main stages:

Form I-140 petition. File as a self-petitioner with USCIS — online via the myUSCIS portal (my.uscis.gov) or by mail to the designated service center. No employer or labor certification is needed. USCIS first assesses EB-2 threshold eligibility, then evaluates the national interest waiver request under the three Dhanasar prongs, then conducts a discretionary analysis. Standard processing takes approximately 18-21 months. Optional premium processing (Form I-907) guarantees a 45-business-day initial response — fee is $2,805, increasing to $2,965 from 1 March 2026.

Green card stage. Once the I-140 is approved and a visa number is available per the monthly Visa Bulletin, the applicant either files Form I-485 for adjustment of status (if in the U.S.) or undergoes consular processing abroad via Form DS-260. Concurrent filing of I-140 and I-485 is permitted when a visa number is immediately current.
Fees (2026): I-140 filing fee $715 and Asylum Program Fee $300 (self-petitioners) both remained unchanged after the FY 2026 HR-1 inflation adjustment effective 1 January 2026, since the 2.70% CPI-U increase rounded down to no change at the $10 increment.
Visa availability depends on the applicant's country of chargeability. Nationals of India and China face significant multi-year backlogs in the EB-2 category due to per-country limits (7% of annual allocation). As of the April 2026 Visa Bulletin, EB-2 worldwide chargeability is Current for both Final Action Dates and Dates for Filing, while India remains backlogged at 15JUL14 (Final Action) / 15JAN15 (Filing) and China is at 01SEP21 (Final Action) / 01JAN22 (Filing). The Department of State has warned that retrogression may be necessary later in the fiscal year if demand materializes.
- The NIW covers only the sciences, arts, and business — education and athletics are not eligible under this pathway.
- The proposed endeavor described in the petition should be specific and forward-looking, not merely a description of past work.
- A petitioner who qualifies under both the advanced degree and exceptional ability tracks need only establish eligibility under one.
- Because NIW now also involves a discrete discretionary analysis, otherwise-eligible petitioners with adverse conduct, immigration history, or social media activity flagged as anti-American may be denied even if they meet the three-prong Dhanasar test.
