Investor Temporary Residence Permit

Azerbaijan's Investor Temporary Residence Permit allows foreign nationals and stateless persons to reside in Azerbaijan based on qualifying capital investments in the country's economy. The program is established under the Migration Code of the Republic of Azerbaijan (Law No. 713-IVQ of 2 July 2013, Articles 45–48), as amended through April 2023 and December 2024. It is administered by the State Migration Service, with applications processed through ASAN Service centres and the electronic services portal. The program offers four qualifying investment categories at different thresholds, with no educational or professional qualifications required.

Applicants must meet one of the following investment criteria:

• Economy investment: at least AZN 500,000 (~USD 295,000) in Azerbaijan's economy — grants a permit for up to 3 years
• Real estate: ownership of property worth at least AZN 100,000 (~USD 59,000)
• Bank deposit: a fixed-term deposit of at least AZN 100,000 (~USD 59,000) with an Azerbaijani bank (current accounts do not qualify)
• State securities: ownership of qualifying state or state-majority-owned entity securities with a nominal value of at least AZN 100,000 (~USD 59,000)

For real estate, bank deposit, and securities categories, the permit is initially issued for up to 1 year and can be extended for up to 2 years per extension, provided the investment basis is maintained.

• Two photographs (3.5 x 4.5 cm)
• Medical certificate confirming absence of dangerous infectious diseases (HIV, Hepatitis B and C)
• Proof of current legal basis for stay in Azerbaijan (valid visa or existing permit)
• Proof of residential address (property ownership, lease agreement, or owner consent with identification)
• Certified documentation confirming the investment basis (property deed, bank deposit certificate, securities ownership confirmation, or investment documentation)
• State fee receipt

The AZN 500,000 economy investment category grants a permit for up to 3 years. The real estate, bank deposit, and securities categories grant permits for up to 1 year, extendable for up to 2 years per extension. Extension applications must be submitted at least 30 days before expiry. After 2 consecutive years of temporary residence on investor grounds, the holder may apply for a permanent residence permit — which requires higher investment thresholds (AZN 200,000 for real estate, deposits, and securities; AZN 500,000 for economy investment).

Spouse, children, and parents aged 65 or older may apply for temporary residence permits as family members under Article 45.1.5 of the Migration Code. Each family member must submit a separate application with a consent letter from the primary permit holder. Family member permits are tied to the primary holder's permit duration. Dependants who wish to work must obtain separate work permits.

Tax residency is determined by physical presence: individuals present in Azerbaijan for more than 182 days in a calendar year are taxed on worldwide income. In the non-oil, non-gas sector, a seven-year income tax exemption applies (0% on monthly income up to AZN 8,000; 14% on the excess). Standard rates for oil/gas and government sectors: 14% on income up to AZN 2,500/month, then AZN 350 plus 25% on the excess. Dividends are taxed at 5%, interest at 10%, and rental income at 14%. Non-residents are taxed only on Azerbaijan-source income.

Applicants must first enter Azerbaijan on a valid visa (business or personal visit). The temporary residence permit application is submitted through ASAN Service centres, the State Migration Service electronic portal (eservice.migration.gov.az), or the MIGAZ mobile application. Processing takes 15–20 working days depending on the fee paid. Expedited processing (15 working days) is available at a higher fee. Upon approval, a residence permit card is issued. Application status can be tracked online. Payment of the application fee does not guarantee approval.

After 2 consecutive years of temporary residence on investor grounds, the holder may apply for permanent residence. Permanent residence thresholds are: AZN 200,000 for real estate, bank deposits, and state securities; AZN 500,000 for direct economy investment. Permanent residence permits are valid for 5 years and renewable. Citizenship may be pursued after 5 years of continuous permanent residence, subject to Azerbaijani language proficiency, proof of legal income, and renunciation of other citizenship (Azerbaijan does not recognize dual citizenship).
