Residence Permit for Private Reasons
Luxembourg's Residence Permit for Private Reasons (autorisation de séjour pour raisons privées) enables financially self-sufficient third-country nationals to reside in the Grand Duchy without engaging in local employment. Established under Article 78(1) of the amended 2008 immigration law and administered by the Direction générale de l'immigration, the program primarily serves retirees receiving EU/Schengen pensions and persons employed in another EU or Schengen member state. Luxembourg does not have a separate retirement visa — this permit is the main pathway for financially independent non-EU nationals. A 2023 amendment significantly tightened eligibility by restricting acceptable income sources exclusively to EU/Schengen professional activity or EU/Schengen social security pensions, eliminating the previous acceptance of income from any worldwide source.
- Sufficient own resources from qualifying sources: professional activity in another EU/Schengen state, or pension from a Luxembourg or EU/Schengen social security institution
- Monthly income at least equal to the social minimum wage for unskilled workers (EUR 2,703.74 as of January 2026)
- Income from non-EU/non-Schengen sources does not qualify following the 2023 amendment
- Bank savings alone are generally not considered sufficient — income must be stable, regular, and recurring
- Comprehensive health insurance valid in Luxembourg covering all risks
- Proof of suitable housing (minimum 12 m² for one person, plus 8 m² per additional occupant)
- Valid passport and clean criminal record
- Application fee of EUR 80
- No educational or professional qualifications required

- Criminal record extract from country of origin or sworn declaration
- Proof of suitable housing in Luxembourg (rental agreement or property deed)
- Comprehensive health insurance valid in Luxembourg
- Civil status and family situation certificate
- Proof of sufficient own resources: pension certificate from EU/Schengen social security institution, or employment contract and salary certificate from employer in another EU/Schengen state
- Power of attorney if applying through a representative (with handwritten "bon pour procuration" notation)
- All documents not in German, French, or English must be translated by a sworn translator
The permit is valid for up to 3 years from the date of the declaration of arrival. Renewal applications must be submitted within 2 months before expiry, with updated proof of continued sufficient resources, social security affiliation certificate, Luxembourg criminal record extract, and EUR 80 fee. After 5 years of continuous lawful residence, holders may apply for EU long-term resident status. Luxembourg citizenship may be acquired after 5 years of continuous residence, subject to Luxembourgish language proficiency and integration requirements.
The self-sufficient resources pathway covers the individual applicant. Family members may join under separate family reunification provisions of the 2008 immigration law, subject to the sponsor meeting income and housing requirements. Unmarried partners with stable, long-standing ties may apply under the family ties pathway (Article 78(1) point 2), which requires a financial guarantee from a Luxembourg-based sponsor. Each family member needs their own comprehensive health insurance, and housing minimums increase by 8 m² per additional occupant.
Holders who maintain a permanent home in Luxembourg or are present for more than 183 days in a calendar year become tax residents. Tax residents are subject to progressive income tax on worldwide income at rates from 8% to 42%, plus a solidarity surcharge of 7-9%. Foreign-source income may be exempt under one of Luxembourg's 86 double taxation treaties, typically using the exemption-with-progression method. Pension income from other EU states may be taxable in Luxembourg depending on the applicable treaty.
The procedure follows two stages. Stage 1 (before entry): submit a written request for temporary authorization to stay to the Direction générale de l'immigration, either directly from the country of origin or through Luxembourg's diplomatic representation. The authority responds within 3 months — no response equals rejection. If approved, a 90-day temporary authorization is issued. Visa-required nationals must then obtain a Type D long-stay visa. Stage 2 (after entry): within 3 days of arrival, declare arrival at the commune of residence. Complete a mandatory medical examination including tuberculosis screening. Within 3 months of arrival, submit the formal residence permit application via MyGuichet.lu or by post. The permit is issued as a biometric chip card.
The permit does not automatically grant work authorization in Luxembourg — a separate work permit may be required for any local employment. Holders who leave Luxembourg for more than 6 consecutive months must surrender their permit and make a formal declaration of departure. For long-term resident status eligibility, temporary absences must not exceed 6 months per year or 10 months total over 5 years. The 2023 amendment means that individuals relying solely on non-EU/non-Schengen income sources — such as rental income from outside the EU, non-EU investment dividends, or non-EU pensions — no longer qualify and should consider Luxembourg's investor residence permit as an alternative.
