Temporary Residence Permit for Investors

Ukraine's Temporary Residence Permit for Investors allows foreign nationals who are founders, participants, or beneficial owners of a Ukrainian legal entity to reside in Ukraine on a temporary basis. Established under the Law of Ukraine "On the Legal Status of Foreigners and Stateless Persons" No. 3773-VI of 22 September 2011, the permit requires an ownership stake equivalent to at least EUR 100,000 in the company's authorized capital. Unlike the immigration permit for investors (which requires USD 100,000 in freely convertible currency and leads to permanent residence), this permit accepts investment in various forms including property and securities, is not subject to annual immigration quotas, and is aimed at investors actively managing a Ukrainian business.

• Foreign national or stateless person who is a founder, participant, or beneficial owner of a Ukrainian legal entity
• Ownership stake equivalent to at least EUR 100,000, assessed at the official National Bank of Ukraine exchange rate on the date of investment
• Acceptable investment forms: monetary contribution to authorized capital, movable property, immovable property acquired in Ukraine, or securities holdings in joint-stock companies
• Simply purchasing real estate without an ownership stake in a legal entity does not qualify
• Valid health insurance policy covering the territory of Ukraine
• No specific educational or professional qualifications required

• Passport with valid Ukrainian type D visa
• Certified Ukrainian translation of passport personal data pages (notarized)
• Certified copy of the constituent documents of the Ukrainian legal entity
• Written commitment from the legal entity to notify DMSU if the investor's status as founder/participant/beneficial owner changes
• Documentation proving the investment amount and form (bank transfer records, property documents, securities certificates)
• Valid health insurance policy
• Receipt of administrative fee payment (approximately UAH 1,140 total: UAH 34 government charge + UAH 452 administrative service fee + UAH 654 blank form)

The temporary residence permit is valid for 2 years and may be renewed by submitting a new application with updated documents before the current permit expires. The permit does not lead directly to permanent residence. To obtain permanent residence, the holder must separately qualify under the Law on Immigration — for example, by making an additional investment of USD 100,000 in freely convertible currency under the immigration permit for investors program.

Family members are not automatically covered by the investor's permit. Spouses, children, and other dependants must apply separately for temporary residence permits on other grounds available under the Law on Legal Status of Foreigners, such as family reunification.

Tax residency is determined by presence of 183 or more days in Ukraine per calendar year, permanent domicile, or centre of vital interests. Tax residents are taxed on worldwide income at 18% personal income tax plus 1.5% military tax. Non-residents are taxed only on Ukrainian-source income. Dividends from Ukrainian companies are taxed at 5%. Holders who become tax residents must obtain a Ukrainian tax identification number and file annual tax returns.

1. Establish qualifying investment — Acquire or establish a founder/participant/beneficial owner stake of at least EUR 100,000 in a Ukrainian legal entity. The EUR threshold is assessed at the NBU exchange rate on the date of investment.
2. Obtain a type D visa — Apply for a Ukrainian type D visa at a Ukrainian diplomatic mission or consular post abroad before entering Ukraine.
3. Enter Ukraine and compile documents — Gather constituent documents of the company, proof of investment, health insurance, and certified Ukrainian translations of passport pages. All foreign documents must be apostilled and translated by a certified translator.
4. Submit application — In person at the territorial DMSU office or a Centre of Providing Administrative Services at your place of residence in Ukraine.
5. Await decision — Processing takes 15 working days from submission of a complete application.
6. Register place of residence — After receiving the permit, register your place of residence at the territorial DMSU office within 30 days.

The Ukrainian legal entity in which the investor holds a stake must provide a written commitment to notify DMSU if the investor's status as founder, participant, or beneficial owner terminates.
